Giveaway Terms & Conditions
These Terms and Conditions apply to giveaways, competitions and promotional activities conducted by KAJO Australia Pty Ltd (“KAJO Australia”, “we”, “us” or “the Promoter”), unless otherwise stated in the specific promotion.
By entering a KAJO Australia promotion, entrants agree to these Terms and Conditions together with any additional conditions stated in the relevant promotional post or advertisement.
1. Eligibility
Unless otherwise stated, entry is open to persons aged 18 years or over with an Australian delivery address.
Employees of KAJO Australia, and their immediate family members, are not eligible to enter.
The Promoter reserves the right to request information reasonably necessary to verify an entrant's eligibility.
2. Promotion Period
The opening and closing dates and times for each promotion will be specified in the relevant promotional post or advertisement.
Entries received outside the stated promotion period will not be eligible.
3. How to Enter
The method of entry will be specified in the relevant promotional post or advertisement.
Entry may require participants to complete actions such as following a KAJO Australia social media account, liking a promotional post, commenting on a post, tagging another account, or completing another specified action.
Unless expressly stated otherwise, no purchase is necessary to enter.
Entrants are responsible for ensuring that their entry complies with the stated entry requirements.
4. Valid Entries
Entries must be submitted by an eligible entrant during the promotion period and in accordance with the stated entry requirements.
Incomplete, fraudulent, automated, duplicate or otherwise invalid entries may be excluded from the promotion.
KAJO Australia reserves the right to verify entries and disqualify any entrant who does not comply with these Terms and Conditions or the conditions of the relevant promotion.
5. Prizes
The prize, approximate recommended retail value and any prize-specific conditions will be stated in the relevant promotional post or advertisement.
Prizes are not transferable, exchangeable or redeemable for cash unless otherwise stated.
If a prize or component of a prize becomes unavailable for reasons outside KAJO Australia's reasonable control, the Promoter may substitute it with an item of similar or greater value, subject to applicable law.
Where delivery is included, prizes will be delivered to an eligible Australian delivery address, unless otherwise stated.
6. Selection of Winners
Unless otherwise specified, winners of chance-based promotions will be selected at random from all valid eligible entries.
The draw date and any relevant draw details will be specified in the promotional material.
For skill-based competitions, the judging criteria and method of determining the winner will be stated in the relevant promotion.
7. Winner Notification
Winners will be contacted using the method specified in the promotion, which may include direct message, comment, email or another reasonable method.
For social media promotions, winners will only be contacted through KAJO Australia's official social media accounts or official KAJO Australia contact details.
KAJO Australia will never request payment, credit card details or banking information as a condition of claiming a giveaway prize.
Where appropriate, the winner's name or social media username may also be announced through KAJO Australia's social media channels, subject to applicable laws.
8. Unclaimed Prizes
Winners must claim their prize within the period specified in the relevant promotion.
If a winner cannot be contacted, does not claim the prize within the specified period, is found to be ineligible, or otherwise fails to comply with these Terms and Conditions, KAJO Australia may conduct a redraw or select another winner, subject to applicable laws.
9. Social Media Promotions
Where a promotion is conducted through Instagram, Facebook or another social media platform, the promotion is in no way sponsored, endorsed, administered by, or associated with that social media platform, unless expressly stated otherwise.
Entrants acknowledge that they are providing their information to KAJO Australia and not to the relevant social media platform.
Entrants must also comply with the applicable platform's terms of use.
10. Privacy
Any personal information collected as part of a promotion will be used for purposes associated with administering the promotion, verifying eligibility, contacting winners and delivering prizes.
Personal information will be handled in accordance with applicable privacy laws and the KAJO Australia Privacy Policy.
Entry into a promotion does not automatically constitute consent to receive marketing communications unless the entrant separately provides such consent where required.
11. General
KAJO Australia reserves the right, subject to applicable law, to modify, suspend, postpone or cancel a promotion if circumstances beyond its reasonable control prevent the promotion from being conducted as intended.
KAJO Australia accepts no responsibility for entries that are lost, delayed, incomplete or not received due to technical issues or circumstances outside its reasonable control.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Where there is any inconsistency between these general Terms and Conditions and the conditions stated for a specific promotion, the specific promotion conditions will apply to the extent of the inconsistency, subject to applicable law.
